How to fill out the DA Form 2823
A written statement made under oath for a law enforcement report, an AR 15-6 investigation, a commander's inquiry, or other official matter. False statements under oath can be punished under the UCMJ. When: When an investigating officer, military police, or your command asks you to put what you saw, heard, or did in writing. If you are suspected of an offense, you must be advised of your rights (DA Form 3881) first, and you may consult a lawyer before making any statement.
Step by step
- Fill blocks 1–8: where and when the statement is taken, the file number the investigator gives you, your name, grade or status, and your organization or address.
- In block 9 write in the first person, in time order: what happened, when, where, who was there, and what you personally saw, heard, or did.
- End the statement with "Nothing follows" (or the investigator's closing questions and your answers), then initial the bottom of each page in block 11.
- Read the affidavit, fill in the last page number, and sign in front of the person administering the oath, who completes and signs the oath block.
What a strong one looks like
- Stick to what you know first-hand. Say "I heard SPC Diaz say..." rather than stating it as fact.
- Use exact times, places, and full names with rank. Say when you're estimating ("about 2215").
- Line through any mistake and initial it; don't erase or use correction tape.
- Write the draft here, but copy it onto the real form or give it to the investigator to transcribe; the sworn original is what counts.
Common mistakes
- Guessing or adding opinions and conclusions ("he was obviously drunk").
- Signing before the oath is administered, or leaving blank space where text could be added later.
- A suspect giving a statement without a rights advisement.
